Terms and Conditions
Last updated: October 25, 2026
These Terms and Conditions (the Terms) govern access to Restyling Jobs, available at https://restylingjobs.com, and the marketing and campaign services provided by ZT Direct LLC (ZT Direct, we, us, or our). By accessing the website, checking the acceptance box at checkout, submitting payment, or using the Services, you agree to these Terms. If you act for a company or other organization, you represent that you have authority to bind it, and Client means that organization.
Important billing terms. The managed service is month-to-month and renews automatically until canceled. The current base service fee is $999 per month unless a different amount is displayed at checkout or agreed in writing. Printing, postage, mailing data, and other fulfillment costs are separate and variable. Cancellation applies to future billing periods only. Fees already charged for the current period are not prorated or refunded. Marketing results are not guaranteed.
1. Eligibility and Business Use
You must be at least 18 years old and legally capable of entering a binding agreement. The paid Services are intended primarily for businesses. If you accept these Terms for a business, you represent that the information you provide is accurate and that you are authorized to approve campaigns, incur charges, and give instructions on its behalf.
2. The Services
ZT Direct provides managed customer-acquisition and marketing services. Depending on the campaign, the Services may include strategy, offer development, list selection or sourcing, copywriting, postcard design, production coordination, printing coordination, mailing, campaign management, response routing, reporting, optimization, and related communications. We may also agree to provide reactivation, email, SMS, advertising, lead-generation, or other marketing services.
The purpose of the service is to give the Client an ongoing managed campaign relationship. After initial setup, ZT Direct may continue running substantially similar campaigns each month without requiring the Client to manage each operational step. We may adjust ordinary campaign details based on performance, availability, postal or vendor requirements, and our professional judgment. Either party may suggest new offers, quantities, formats, audiences, or channels. A material change that creates additional charges will be disclosed before those charges are incurred.
The scope of a particular purchase may also be described on a checkout page, proposal, invoice, campaign notice, email confirmation, or other written communication (the Order Details). The Order Details are incorporated into these Terms. If clearly stated Order Details conflict with these Terms, the Order Details control only for that specific subject and purchase.
3. Monthly Base Service Fee
Unless different Order Details apply, the base service fee is $999 per month. The first payment is charged when the Client enrolls. The service then renews and the base fee is charged automatically each month on the recurring billing date until canceled.
The base fee retains ZT Direct to manage the Client relationship and campaign strategy during that billing period. It covers the professional management, creative, coordination, and ongoing service ZT Direct determines are appropriate within the agreed relationship. It does not purchase a guaranteed number of leads, appointments, customers, sales, mail responses, or completed projects.
The base fee does not include the underlying cost of printing, postage, mailing lists or data, postal processing, mail-house services, specialty production, or other third-party fulfillment unless the applicable Order Details expressly say otherwise.
4. Mailing and Fulfillment Charges
The Client is responsible for all mailing and fulfillment charges associated with its campaigns. The amount may vary between batches based on quantity, format, paper, printing specifications, postage rates, mailing class, geographic targeting, list or data requirements, processing, vendor pricing, and other production details. A prior batch price does not guarantee the price of a later batch, even when the batches appear similar.
ZT Direct will provide the applicable batch price or charge information before the amount is charged or committed. The Client authorizes ZT Direct and its payment providers to charge the payment method on file for disclosed mailing and fulfillment charges associated with the Client's active campaign and standing instructions. When exact vendor pricing cannot be determined until a batch is configured, the amount disclosed for that configured batch will be the controlling amount.
Ongoing monthly mailing is a central part of the managed service. A Client that no longer wants future monthly campaigns must cancel before the next renewal. Refusing or failing to pay an ordinary disclosed mailing charge does not entitle the Client to a refund of the base fee and may result in suspension or termination.
Quantities described as "about," "approximately," "to start," or similar language are estimates. Final usable quantities may vary because of data availability, address hygiene, postal requirements, production tolerances, or agreed campaign adjustments.
5. Authorization to Charge and Payment Failures
By purchasing a subscription, the Client authorizes recurring charges for the monthly base fee and authorizes separate charges for disclosed campaign, mailing, and fulfillment costs. The Client must maintain a valid payment method and promptly update billing information when necessary.
If a payment fails or is reversed, we may retry the charge, suspend work, withhold a campaign from production or mailing, suspend access to deliverables or reporting, or terminate the Services. The Client remains responsible for amounts validly incurred before suspension or termination, as well as legally permitted taxes, collection costs, and chargeback expenses attributable to an improper dispute.
Prices do not include taxes unless stated otherwise. The Client is responsible for applicable sales, use, excise, or similar taxes, excluding taxes based on ZT Direct's net income.
6. Cancellation and Refunds
The subscription is month-to-month and may be canceled by emailing [email protected] or using the contact method identified on the website. Cancellation must be received before the next recurring billing date to prevent the next monthly charge. Cancellation becomes effective at the end of the current paid billing period and affects future periods only.
Monthly base fees are nonrefundable once a billing period begins. There are no prorated refunds or credits for an unused portion of a month, a Client delay, inactivity, a change of mind, dissatisfaction with results, or cancellation during a paid period. Work and the mailing planned for the current paid period may continue after a cancellation notice.
Mailing charges are nonrefundable after the applicable postcards or other materials have been released for delivery or entered the mail stream. Once mail has entered the delivery stream, it cannot be recalled, stopped, or canceled. Before that point, any refund or credit is discretionary and may exclude completed work and nonrecoverable third-party costs.
If ZT Direct causes a material production error, our obligation and the Client's exclusive remedy will be, at our reasonable option, to correct the error, rerun the materially affected portion, or provide an appropriate service credit. We are not responsible for hypothetical sales, profits, or opportunities allegedly lost because of an error.
7. Client Delays and Cooperation
The Client must provide accurate business information, offers, contact details, branding, access, campaign instructions, payment information, and reasonable cooperation when requested. The Client must review requests and respond within a commercially reasonable time.
The base fee continues while the Client remains active, including during periods when work is delayed by missing information, access, instructions, materials, approval, payment, or other Client action or inaction.
Client inactivity does not automatically pause the subscription or extend a paid billing period. The Client must cancel to prevent future renewals.
8. Campaign Instructions and Approval
ZT Direct may request the Client's approval of an initial template, offer, business information, or campaign concept. Once approved, that approval becomes a standing instruction for later campaigns that are substantially similar. We do not need fresh approval for every routine batch or for ordinary production changes, date changes, tracking details, formatting adjustments, postal requirements, minor copy edits, list refinements, or similar operational decisions.
We may request new approval for a material change to an offer, price claim, guarantee, core campaign concept, or other significant representation. Whether or not we request approval, the Client is responsible for the accuracy, substantiation, and legality of the Client's business information, offers, warranties, guarantees, pricing, licensing claims, testimonials, logos, photographs, trademarks, and other materials or instructions it supplies or approves.
9. Client Data and Lawful Contact Authority
The Client may provide customer, lead, prospect, or campaign data for reactivation or other services. The Client represents and warrants that it lawfully collected or obtained the data and has provided all required notices and obtained all rights, permissions, and consents necessary for ZT Direct and its providers to process the data and perform the requested campaign.
For email, telephone, or SMS campaigns, the Client must possess any consent required for the particular recipient, message, sender, and technology used. At our request, the Client will provide reasonable evidence of consent, including the consent language, source, date, time, and associated contact information. ZT Direct may reject, pause, or terminate a campaign when consent or list provenance is inadequate, unclear, disputed, or inconsistent with law or provider policies.
The Client must promptly communicate unsubscribe requests, do-not-contact requests, consent revocations, complaints, and other suppression information relevant to a campaign. Both parties may retain suppression records as reasonably necessary to honor those requests.
The Client must not provide Social Security numbers, complete payment-card information, medical or health information, information about children, authentication credentials, or other sensitive personal information unless ZT Direct has expressly agreed in writing to process it.
10. ZT Direct Sourced Lists and Campaign Data
ZT Direct may obtain prospect or mailing information from public records, property records, business directories, commercial data providers, list providers, or other permitted sources. Third-party and public-source data may be incomplete, outdated, duplicated, or inaccurate, and ZT Direct does not warrant that every record is correct or deliverable.
Unless expressly agreed in writing and permitted by the applicable source license, ZT Direct retains control of internally sourced mailing lists and does not transfer, sell, or provide the raw list to the Client.
The Client receives the managed campaign, campaign reporting, and information from people who respond to the Client's campaign. The Client may use respondent information for legitimate follow-up concerning the offer to which the person responded and must handle that information lawfully.
Undeliverable mail, postal delays, duplicate or stale records, recipients outside an intended profile, recipient nonresponse, and reasonable list variation are campaign risks and do not by themselves create a right to a refund or credit.
11. Leads and Client Customer Relationships
ZT Direct may route calls, forms, messages, inquiries, appointments, or other responses to the Client. A response or inquiry is not a guarantee that the person is qualified, will answer follow-up communications, will schedule or keep an appointment, will purchase, or will remain a customer.
The Client is solely responsible for responding to leads; providing estimates; making disclosures; obtaining permits and licenses; entering customer contracts; performing tint, PPF, ceramic coating, wrap, or other services; collecting payment; handling cancellations, warranties, complaints, and refunds; and complying with laws governing its business. ZT Direct is not a party to transactions between the Client and its customers and is not responsible for the Client's work, statements, pricing, safety, or customer service.
12. No Guarantee of Results
Marketing performance depends on numerous factors outside ZT Direct's control, including the Client's offer, reputation, pricing, market, geography, competition, seasonality, list quality, economic conditions, sales process, response time, capacity, and customer behavior.
ZT Direct does not guarantee any particular number of delivered pieces, responses, calls, leads, appointments, estimates, projects, customers, sales, revenue, response rate, conversion rate, profit, or return on investment. Examples, projections, prior results, testimonials, or statements about possible outcomes are illustrative and are not promises that the Client will achieve the same or any result.
13. No Automatic Exclusivity
The Services are nonexclusive. ZT Direct may serve other businesses, including businesses in the same industry or geographic market. Geographic, category, or other exclusivity applies only when expressly stated in a separate written agreement that defines the territory, scope, duration, exceptions, and additional price.
14. Intellectual Property
ZT Direct and its licensors retain all rights in the website and in ZT Direct's templates, postcard designs, copy frameworks, campaign structures, strategies, methods, processes, selection criteria, automations, workflows, software configurations, source files, data organization, know-how, and reusable or non-Client-specific materials (collectively, ZT Direct Materials). The Client purchases a managed service, not ownership or delivery of ZT Direct Materials.
The Client retains ownership of logos, trademarks, photographs, factual business information, and other materials it provides (Client Materials). The Client grants ZT Direct and its providers a worldwide, nonexclusive, royalty-free license to host, reproduce, modify, print, display, transmit, and otherwise use Client Materials as reasonably necessary to provide, document, and support the Services. The Client represents that it has the rights needed to grant this license.
Unless expressly agreed otherwise, the Client is not entitled to raw mailing lists, editable design files, source files, automation configurations, internal prompts, vendor accounts, or ZT Direct's working materials. ZT Direct may reuse general concepts, layouts, systems, learnings, and nonconfidential components for other clients.
A complimentary sample postcard may be used by the recipient for that recipient's own business marketing. This limited, nonexclusive, nontransferable license does not include editable or source files and does not permit resale, sublicensing, distribution as a template, or use by another business.
If the Client voluntarily provides suggestions or feedback, ZT Direct may use them without restriction or compensation, provided we do not publicly disclose the Client's confidential information in doing so.
15. Confidentiality
Each party will use reasonable care to protect nonpublic business, technical, customer, pricing, and campaign information disclosed by the other and will use it only for the relationship contemplated by these Terms. Confidential information does not include information that is public through no breach, already lawfully known, independently developed without use of the other party's information, or lawfully received from another source.
ZT Direct may disclose confidential information to employees, contractors, professional advisers, and service providers who reasonably need it to perform or support the Services and who are subject to confidentiality or professional obligations. A party may also disclose information when required by law, legal process, or a valid government request.
16. Third Party Providers
We may use third-party platforms and providers for CRM, automation, payments, email, SMS, telephony, analytics, data, printing, mail preparation, postal delivery, hosting, security, and other functions. Their availability, processing times, pricing, policies, and performance are outside our complete control. We may select, replace, or discontinue providers as reasonably necessary to deliver the Services.
ZT Direct is not responsible for a third party's independent acts, outages, delays, policy changes, data inaccuracies, or service failures, except to the extent caused by ZT Direct's failure to exercise reasonable care in selecting or managing that provider. Links to third-party websites do not constitute an endorsement, and use of those websites may be governed by separate terms and privacy notices.
17. Acceptable Use
You may not misuse the website or Services; interfere with their operation or security; attempt unauthorized access; introduce malicious code; scrape or copy protected content at scale; impersonate another person; use the Services for fraud, harassment, discrimination, deception, unlawful solicitation, or illegal activity; or direct us to transmit content or communications that violate law, third-party rights, or provider policies.
ZT Direct may refuse any offer, audience, content, data, or instruction that we reasonably believe creates legal, security, reputational, deliverability, safety, or provider-policy risk.
18. Suspension and Termination by ZT Direct
We may suspend or terminate the Services immediately for nonpayment, chargeback abuse, unlawful or misleading instructions, inadequate contact consent, misuse of data, provider-policy violations, threats or abusive conduct, material breach, security risk, or repeated failure to cooperate. Suspension or termination does not eliminate amounts already owed and does not require us to recall mail, reverse committed vendor work, or refund the current monthly fee.
We may also decide not to renew a Client for a future month by providing reasonable notice. When we discontinue an account for an ordinary business reason rather than Client breach, the termination will generally take effect at the end of the current paid period.
19. Disclaimer of Warranties
To the maximum extent permitted by law, the website and Services are provided "as is" and "as available." ZT Direct disclaims all express, implied, and statutory warranties not expressly stated in these Terms or applicable Order Details, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the website, Services, providers, campaigns, data, communications, or delivery will be uninterrupted, error-free, secure, timely, or perfectly accurate. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
20. Limitation of Liability
To the maximum extent permitted by law, ZT Direct and its owners, affiliates, employees, contractors, licensors, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings; business interruption; the Client's services or customer disputes; or damages arising from postal delay, undeliverable mail, inaccurate third-party data, provider outages, or recipient conduct, even if advised that such damages were possible.
To the maximum extent permitted by law, the total aggregate liability of ZT Direct and the other protected parties arising from or relating to the website, Services, a campaign, or these Terms will not exceed the base service fees actually paid by the Client to ZT Direct during the three months immediately preceding the event giving rise to the claim. Pass-through amounts for postage, printing, mailing data, production, taxes, and other third-party costs are excluded from that calculation.
These limitations do not apply to liability that cannot lawfully be limited. The limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.
21. Indemnification
The Client will defend, indemnify, and hold harmless ZT Direct and its owners, affiliates, employees, contractors, providers, and agents from claims, demands, investigations, proceedings, damages, judgments, penalties, fines, liabilities, costs, and reasonable attorneys' fees arising from or relating to:
Client Materials, claims, offers, guarantees, instructions, products, or services;
data or contact information supplied or authorized by the Client;
an allegation that the Client lacked required notice, permission, or consent for email, telephone, SMS, direct-mail, advertising, or other processing;
the Client's violation of law, provider policy, these Terms, or a third party's rights;
the Client's follow-up, sales practices, contracts, automotive restyling work, customer service, warranties, or relationship with a lead or customer; or
fraud, negligence, willful misconduct, or unauthorized acts by the Client or its personnel. ZT Direct will promptly notify the Client of a covered claim and reasonably cooperate in the defense. The Client may not settle a claim in a manner that admits wrongdoing by or imposes nonmonetary obligations on ZT Direct without our written consent.
22. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a lawsuit, each party agrees to provide written notice describing the dispute and to attempt in good faith to resolve it informally for at least 30 days. Either party may bring an eligible claim in small claims court without completing that informal period when necessary to preserve the claim.
Any lawsuit that is not eligible for small claims court must be brought in the state or federal courts located in Sacramento County, California, and each party consents to their personal jurisdiction and venue.
Nothing in this section prevents either party from seeking temporary or emergency relief to protect confidential information, intellectual property, data, security, or payment rights.
23. Changes to Services, Prices, and Terms
We may modify the Services, base subscription price, or these Terms. For an existing paid Client, a change to the base subscription price will apply no earlier than the next renewal following at least 30 days' advance notice, unless the Client expressly agrees sooner. The Client may cancel before the change takes effect. Ordinary fluctuations in separately disclosed printing, postage, data, or fulfillment charges are not changes to the base subscription price.
Updated Terms will be posted with a revised "Last updated" date. When legally required or when a change materially affects an active paid relationship, we will provide additional notice. Continued use or renewal after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
24. Electronic Communications
The Client agrees that we may provide agreements, invoices, receipts, campaign notices, disclosures, renewal or price notices, and other service communications electronically using the email address, phone number, website, or platform associated with the Client. The Client is responsible for keeping contact information current and for monitoring communications related to the Services.
25. General Terms
Neither party is liable for delay or failure caused by events beyond its reasonable control, including postal disruption, carrier delay, vendor outage, supply shortage, labor dispute, natural disaster, severe weather, epidemic, war, civil unrest, government action, utility failure, or internet or platform failure. Payment obligations for amounts already incurred are not excused.
The Client may not assign or transfer the agreement without ZT Direct's written consent. ZT Direct may assign it in connection with a merger, reorganization, financing, sale of assets, or transfer of the Restyling Jobs business.
These Terms, the Privacy Policy, and applicable Order Details constitute the entire agreement concerning their subject matter and replace prior discussions or representations concerning that subject. A modification specific to one Client must be in a written communication accepted by both parties.
If a provision is held invalid or unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue. A failure to enforce a provision is not a waiver. Headings are for convenience only. Provisions that by their nature should survive termination, including payment, ownership, confidentiality, disclaimers, liability limitations, indemnification, and dispute provisions, will survive.
